All of our proposals linked (in the bottom note) to theses terms and conditions and are considered read and understood by the customer and are applicable immediately. If for any reason the customer is not comfortable with one of the clauses, it needs to be address by writing to 1000 Kolo di Karibe BV at least a month before the date of the job starts.
1) WORK STANDARD:
All work is to be completed in a workman-like manner according to standard paint practices. Work site will be kept properly cleaned when the customer or tenants are living in on a regular basis and cleaned by brooming and removing residue, spots of paint on glass, floors if drops appear even if well covered upon completion of the project agreed on proposal. All agreements are contingent upon the absence of strikes, accidents, weather or delays beyond our control.
The contractual work is job and item specific. In no case shall 1000 Kolo di Karibe be responsible for "damage caused by others" or "latent damage" as herein described. We cannot be held responsible on a roof job if leaking happened since the construction base is what will make a roof leak and the paint is coating to help but by itself cannot resolve the whole problem alone.
1000 Kolo di Karibe will deliver a "properly painted surface." A "properly painted surface" is defined as uniform in appearance, color, texture and sheen except for special effects products such as "Cemcolori". It is also free of foreign material, lumps, skins, runs, sags, misses, or insufficient coverage. It is a surface free of drips, spatters, spills or overspray caused by the painting and decorating contractor's workforce. In order to determine whether if a surface has been "properly painted" it shall be examined without magnification at a distance of thirty-nine (39) inches or one (1) meter, or more, under finished lighting conditions and from a normal viewing position.
If we order and import materials (other than paint) on your behalf and the (interim) payment terms agreed in the quotation are not met, the products will be (temporarily) stored and the extra costs the transportation company charge us, will be charged to the client until the items are delivered.
2) CUSTOMER RESPONSIBILITY:
For your safety, no one is permitted in work areas other than employees of 1000 Kolo di Karibe. As with all work site improvement projects, children and pets should be kept away from work areas and from our supplies and equipment.
It is essential that work areas be available exclusively to 1000 Kolo di Karibe, free from other tradespeople, installers, cleaners, etc. If our working space is interfered with, a special agreement taken previously to start the project may be taken between the two parties (company and customer). If no agreement is taken we may leave the job and additional charges may be incurred.
All alarms must be turned off while work is in progress. Make any necessary arrangements for pets. The customers have to remove any valuable, fragile items from the job site. The customer needs to prepare ahead of time, before our arrival, so that the crew can begin the work as scheduled. 1000 Kolo di Karibe cannot be taken responsible if the customers didn’t acknowledge this clause and didn’t remove outside areas need to be cleaned of trees, weeds that can obstruct the paint on any surfaces. 1000 Kolo di Karibe takes the freedom to not paint a certain area if judged not properly cleared and cleaned previous to the start of the project, or charge additional cost for the “gardening” cutting additional time spent to make the surface accessible or for extra deep cleaning. High pressure wash with a proper machine is always necessary and covered for outside job.
Any customer responsibilities not completed may result in additional labor and material costs.
3) UNFORESEEN CONDITIONS:
Because of unforeseen conditions, additional repairs/costs may become necessary. The customers will be notified if any such conditions exist at time of discovery and will be required to approve by writing for said repairs. Examples of unforeseen conditions are: dry rot, moisture damage, high/elevated substrate moisture content, excessive UV damage, dead wood fibers, etc. Should the customer decide to opt out of performing contractor recommended repairs, all areas called out to be repaired are to be removed from the performing approved proposal as we will refuse to simply paint over what we judge “damaged surface”.
4) COST:
We offer to provide material and labor – complete and in accordance with the proposal specifications, for the sum of all as stated in the proposal. If only partial tasks are completed from the full job description, additional pricing may be required. The quoted price is valid for 30 days, unless otherwise noted.
Residential Carpentry/Construction Limited Warranty:
1000 Kolo di Karibe warrants all labor performed and material installed at job site, in accordance with the contract, drawings, specifications, alterations and additions thereto, for a period of (1) one year from date of installation.
The warranty provided by this limited warranty is limited in coverage. The performance standards provided in this limited warranty are the only express warranties covering the work site. To the extent allowed by law, 1000 Kolo di Karibe shall not be liable for any incidental or consequential damages relating to, or resulting from, any damage to, or defect in, the work site, other improvements or the lot on which the work site is located.
If any paint failure, including chipping or peeling occurs on any Interior or Exterior painted or stained surface due to workmanship error for the period of one month, we will provide all Labor and Materials to repaint the affected area and if the problem reappear we cannot be held responsible when we describe as being related to factors beyond our control. This limited warranty is contingent upon receipt of full payment, as billed, for the work that was completed.
This limited warranty excludes all painted or stained horizontal surfaces (i.e. decks, floors, steps, cap rails, horizontal window trim ledges, thresholds, etc.). This limited warranty excludes coating failure due to rot, dead wood fibers as a result of previous excessive UV exposure to bare wood areas, mold or water damage of any kind, high/elevated moisture content levels in substrate, excessive temperature changes, settlement, acts of nature, insect or pet damage, previous coating failure or abuse, previous repaired/patched sections exceeding ¼ inch deep, repeated abrasion, reoccurring or newly formed cracks in the painted surface and all surfaces painted with customer supplied material. This limited warranty excludes “nail pops” and/or “cracks” in caulked/patched areas as result of expansion and contraction in wood, plaster and drywall surfaces. This limited warranty also excludes rust/corrosion/oxidation formation on any and all interior and exterior metal surfaces including nail/screw heads, flashing, deck and railing hardware, metal lights and fixtures, metal garage doors, metal entry doors, etc. This limited warranty excludes windows with compromised seals resulting in condensation inside of the pane. Slight fading of bright or deep colors over time is normal and is not considered paint failure.
Under This Limited Warranty, 1000 Kolo di Karibe does not warrant and shall not be responsible for, and this Limited Warranty shall not extend to or include, or be applicable to, any of the following:
A) Any work performed or material supplied incident to construction, modification or repairs (cracks and plaster) to the work site performed by Customer, or by anyone on behalf of customer, other than 1000 Kolo di Karibe or its employees, agents, subcontractors or contractors providing work or materials at the direction of 1000 Kolo di Karibe.
B) Any damage to the work site, to the extent it is caused or made worse by the failure of Customer or by anyone other than 1000 Kolo di Karibe, its employees, agents, subcontractors or contractors providing work or materials at the direction of 1000 Kolo di Karibe, to comply with the warranty requirements of the manufacturers of any fixtures, appliances and equipment.
C) Humidity or condensation due to the failure of Customer to maintain adequate ventilation, or the effects of such failure on the work site or any other defect to the work site caused by moisture, rot, mildew or rust.
D) Normal wear and tear or normal deterioration.
E) Normal shrinkage resulting from drying or settlement of construction components within the tolerance of building standards.
F) Loss or damage caused by or resulting from or in connection with all named weather events, accidents, riot and civil commotion, fire, explosion, smoke, water escape, falling objects, aircraft, vehicles, lightning, windstorm, hail, flood, hurricane, drought, tropical storms, gale force winds, extreme temperatures, mudslide, earthquake, or other Acts of God, wind driven rain or other water, subsidence or sinkholes, changes in the underground water table, or below ground water that exerts pressure on, seeps, or leaks into the work site, sidewalk, driveway, foundation, swimming pool or other structure.
G) Loss or damage caused by or resulting from seepage of water, unless such loss or damage is a direct result of a defect.
H) Loss or damage caused by or resulting from soil movement including without limitation heaving, subsidence, expansion or lateral movement of the soil for which compensation is provided by legislation or which is covered by insurance.
I) Damage caused by erosion.
J) Damage caused directly or indirectly by insects, birds, rodents, vermin or other wild or domestic animals.
K) Loss or damage which arises while the work site is being used for nonresidential purposes or for purposes for which the work site was not designed; loss or damage caused by or resulting from abnormal loads placed on floors by Customer; loss or damage caused by or resulting from unusual or abnormal demand on the electrical system or other damage that results if the work site has not been maintained, or has been negligently damaged or abused.
Pictures will be made before and during the work in progess, stored safely and used in case of warranty discussions.
5) MARKETING:
Yard Signs:
Upon beginning an interior or exterior project, 1000 Kolo di Karibe may display a yard sign on your lawn or hang a banner. Please notify us if it is against regulations with your HOA or if it is something you do not want displayed.
Project Photos:
1000 Kolo di Karibe will take before and after photos of the project to publish on our website or use for other marketing materials on our Facebook professional page. Please notify us if you do not want photos taken of your project.
